Old Claim Question - Technical Answers Needed

as already mentioned before... being an unlicensed driver has nothing to do with this. if the car was parked, then there is no driver!

if you hit a parked car, you're at fault.

with that being said, having to make a court appearance seems unnecessary.
 
the car wasnt parked. Both cars were moving with a driver inside.

also i probably wasnt told the whole story. he doesnt even know why he has to goto court. he never agreed to the fault but the claim was paid out without him knowing.

the agent he gave all the documents and details too just told him youre at fault we paid out end of story. months later agent calls, you need to show up in court.
 
Both cars moving......? The guy hit but uninsured has'nt settled... uh-oh...whiplash claim?
Weird...wife one time did something similar - came home said she'd backed into guy her vehicle unhurt other guys was
He got out as did she, he says, "no harm done, lets forget it." Then he drives off. I tell her to report it to ins. They agreed he was likely uninsured but said she'd done the right thing. They put it on her driving record as one accident in last three yrs even tho no claim was ever filed.
Trust auto insurers -- no cost ever to them but.....
Dunno, everyone has to decide personally. How could a two vehicle accident involve only one vehicle?? Who was most honest??
 
No license, expired license, suspended license or had subway for lunch, none of this has anything to do with who was at fault. It's a nonsense defense.

Insurance companies don't require permission to file a proper claim. Well, they do, but you signed that when you signed the policy app. A lot of claims would go unsettled (and off to court) if the insured had to agree to paying it out.

Wait till you have a claim from someone making a left turn and they get hit by an oncoming car. You'll hear all about how they MUST have been speeding. Truth is, it doesn't matter. When you make that turn, you have to account for the oncoming traffic and their speed. They had the right of way. Same here. Backing never has the right of way and almost always will be the at fault party.

Dan, something I have always been curious about and maybe you can help.

Let say I am backing out of a space. It is all clear and I back out. I am not mostly or maybe even fully backed out and a car comes barreling along and hits me. From an insurance standpoint, who is at fault? Me because I was in the process of backing up when hit, or the person that hit me?
 
Sounds like your story. But anyways i just wanted to say that your friend has to go to court because he hit a car in parking lot irrespective of intentions. Second the law is very stupid in case of claiming the insurance. You can't do anything about this. Yeah ny the looks of things he is got pushed around.
 
Ah, i understand it now. Thanks for the help now i just have to figure a way to explain this and plant seeds and hopefully he will become my client.
