Post Termination Non-compete

Unlikely they have a non-compete in the sense of they can still be an agent somewhere else and sell to prospects.

At the same time, they are very likely under agreement to not poach (or at least not to actively market to) existing carrier clients, at least the ones that had a relationship with their prior agency.
 
I don't know about Texas, but in California non compete agreements are unenforceable.

While they are legally non enforceable, they can be used to make your life a living hell, tie you up in court, harass you, etc.
