The beni is in prison... now what?

Additional information on this case. I called the company yesterday only to find that a claim was made and the beni signed paper work for the funeral home. The kicker is that the beni was in prison at the time.

Hmmm... to make things more interesting, a family member who would have inside information in this case, had no knowledge that a claim had been made.

It wouldn't be the first time I've heard of a funeral director either forging, or getting a family member to forge a missing bene sig. :no:
I remember a case where the bene was actually deceased when she signed the claim form! :swoon: (She went straight to the funeral home after voting...:D)

Key to this party is that I sent the other family member right over to the funeral home. Wonder how a judge would view a forgery. I wonder if the money was even applied to the funeral. Now that would be interesting to know wouldn't? :yes:

Has the claim been paid? Did you tell the carrier about the incarcerated beneficiary?

No specifics, but less than a grand as it was a GI @ less than 2.

Yes, and yes to your last. I made specific mention to the beni situation to the CS rep, hope she added it to the file notes.

I don't want to get into all the drama on this one, but because of my natural inquisitive nature, I can see me calling to "follow-up" in the near future. ;)

I thought about my case a little more. I think the wife took some POA docs and a witness to the prison and had him sign it. He remained as the bene, but she was able to handle the proceeds on his behalf.

I think he liked that, because it let his wife be the "bad guy" to the rest of the family. In this case, the funeral had already been paid for by the attorney that was suing the at fault driver who killed her. So he wanted the insurance proceeds to go to his own family.

His siblings felt differently about that. Thought they should all get a cut. One of them called and was somewhat threatening to me! Oh well! Nothing I could do about it, even if I wanted to (I didn't). I think as he signed the docs he was also pointing a special finger in their direction!:D
