The Disability Jerk Around

Dead on the money sportsnut - they are waiting him out. Their belief is if they jack him around long enough maybe he won't be disabled anymore.

AFTER doctors records and AFTER 7 years of tax returns the latest - asking for one full year of client billing statement is pure kaka.

No one can give him an answer - they close at 4pm (gotta love that job!) and it doesn't matter who's on the phone - it's the wrong department and we have to be transferred.

After we're transfered a few times the line goes dead - then it's time to start over. If you finally reach anyone with any "say" it's just "it's still under review." They refuse to comment further.

Unum took their company and reputation down the tube by handling claims that way. When the times comes, tie up with one of the lawyers who handled claims against Unum.
You can probably google around with the words "unum" "class action" etc and tie into one of the many online groups of people banded together to fight them. Unum has settle quite a few already either willingly or by court order. It is criminal.
 
almost nothing to lose for the carrier....drag it out a few months, finally cave in and start paying and they've avoided shelling out a few checks. End up in court? Fine - probably the only judgment would be to start paying and possibly remit some pay back - again, nothing much to lose for the DI company.
 
Could it be that in Guardian's take over of this block of business, the records never made it over? They could be stalling in hopes you have copies that will actually provide them with the information they need?

Not trying to side with them, but maybe they simply don't have much more than a file with a name on it and you are basically filling it for them. Ask em. I've never heard of anybody asking for 7 years of returns. How old is the policy?

All I know is I've used my disability policy once and everything went Ok. That was 11 years ago and you can't buy mine anymore as the wording was/is too good.

John, some years ago when I was with New Enland Life I did sell DI and became aware of a guy named Art Fries----not personally. He is a health broker in Newport Beach, CA, but has a nationwide practice as a DI Claims Consultant. I understand he has a very good reputation. On his website he advertises "Disability Claims Advice for Physicians, Dentists, Attorneys and Other Professionals." Also he states that there is no fee for the intial telephone consultation. I think it may be worthwhile to give him a phone call. His name is Arthur L. Fries, RHU, and his toll free number is

Agents selling disability can confirm - but what I've also heard is payments will start - then suddenly stop without warning. Then the client has to go through the ringer again to get the payments going.

Wait a minute. Aren't you the man who believes without reservation in the private sector as THE ONLY means to serving the public for health and disability insurance needs?

You run an association of greedy agents with a platform of "screw those who can't afford it... they are irresponsible anyway!" Now you are up against a greedy carrier... who seems to agree with your platform. Tell me again how the entire health and DI system is not broken and needs radical reform. I'm listening.

Second: What about simplified issue - non med- like Assurity...Does Assurity and Colorado Banker's life simplified issue DI - do these companies in particular play these same games with nonpayment of claims?

And further, why even sell DI when you could just sell CI - and get a lump sum payout from day one without an elimination period and worrying about the definition of own occupation verses any occupation, etc???

Do CI companies jerk clients claims off as well and claim a claim isn't a claim? Who has experience with CI copanies paying and/or not paying as well, like John's DI example?

You are claiming that CI is the equivalent of LTD? Again, I ask the above question and again you have answered it.

What can you get from CI? $10K, 20K, $100K? And that is going to last you a lifetime should you be a surgeon or a dentist and lose a couple of fingers on each hand in an accident?

CI has its place, but don't confuse it with LTD. Better yet, find an agent or a good GA and have them mentor you. You obviously don't know what you don't know.

Get appointed with Colonial or Aflac, take their training and write for them for six months to a year and get your questions answered along with some experience in CI and at least STD.

You say I'm the total jerk-off here? Maybe so... but I know the difference between CI and LTD. You obviously don't. Good luck doing your next buy-sell case when you try to offer CI instead of LTD. I'd love to see THAT sales presentation and see them kick your ass out the door and across the street!
 
Do a google search for disability lawyers. I did and lots of sites popped up and talked about this problem. I would call a few and get some free advice. I assume his wife is recording all calls and using certified mail in corresponding. If Guardian is the contact I would like to know, just because it wasn't their original paper doesn't mean they should slow walk the claim. I assume he is past the incontestability period. However, I do know the companies have to closely review many claims , especially mental and nervous claims. As mentioned earlier, many companies nearly sunk when these claims came in several years ago. I have seen several claims with Provident and UNUM and not any problems. Good luck, really feel for them.
