26y male, legal resident from abroad and uninsured. Currently his wife 25 and daughter are in the U.S.A on a tourist VISA and I don't know if they are overstaying there departure date. He wants to enroll the family in Obamacare.
Question:
-Can it be done?
-If so how do I determine his household and MAGI?
-As the family at this point is invisible for government purposes, should I consider him married or not,
-Can he enroll the child in medicaid?

In order to enroll you must file taxes (jointly if married). To the best of my knowledge, tourists do not file taxes....

My question is still unanswered. Will the household of the alleged family be 3 (one legal and two illegals) or just one legal? This makes a huge difference as my legal customer may not have enough income to qualify for subsidies in a 3 member household.
Please advise.
