Ha - I'm sure there is a huge difference between a telemarketer and a licensed insurance agent . . .

If the above was the case - nobody could sell over the phone.

Man you justify everything so that it works out in your favor regardless of laws and regulations.

I appreciate y'alls suggestions. But think about it - if cold calling for Life Insurance was illegal - all the companies that sell Telemarketed Leads, Advatar Leads, Live Transfers, Pre-Set Appts, etc - would not be able to function and out of business . . .

It's not rocket science guys. Dialers are legal - just not Robo Dialers . . .

Gary's is just a Predictive Dialer - big difference.

Unless they have their phone number listed on the DNC - they are fair game to be called / dialed during appropriate hours . . . Just can't use Robo Dialer.

This isn't email with the CAN-SPAM act or unwanted Texts.

You showed me that a tele-marketer can't ask - has nothing to do with a licensed agent. Plus - this could never be enforced even if so.

So everybody is doing it, it must be legal. A few guys poach in my area it must be legal. hmmmm.

Doesn't every tele-sales Agent collect payment info? You are kind of reaching now Chase.

They are actually. But everybody is doing it. And the law doesn't need to say Licensed agents can do it, it is a sales solicitation. You just don't know what you don't know and you are trying to interpret a black and white law to fit your wants. That is not good business. Plus you need written consent just to call them in the first place.
