But it's not rocket surgery so I'm sure he'll be successful. NOT!

Why is anyone giving him the time of day?

You showed me that a tele-marketer can't ask - has nothing to do with a licensed agent. Plus - this could never be enforced even if so.

If this was the case - then Agents buying Telemarketed Leads would be in violation.
Either way it doesn't matter but, if the telemarketer calls with the intend to make a sale and get payment info, then illegal, it doesn't matter about the license.

Yes and according to the law it is illegal. This isn't brain surgery, the law is the law. You can't dispute the law regardless if others are doing it. If you make an outbound call with the intent (at some point down the line) to sell something, on any device (except a rotary phone or those old push button phones) you need "Express Written Consent) So YES even telemarketer leads are illegal, just as illegal as avatar and robo calls etc.
 
On July 17, 2015, the FCC issued new rules regarding TCPA in an attempt to clarify this area of law. While the new rule results in a number of changes to the TCPA, none is more significant than the broadening of the definition of an "automated telephone dialing system" (ATDS). In simplest terms, the FCC now defines an ATDS as any equipment that is actually or potentially able to dial random or sequential numbers – even if not actually used that way, and even if it must be altered in order to be capable of doing so. In essence, your iPhone can be considered an automated dialer in certain circumstances.

Under TCPA, a consumer must provide written Express Consent to be called, and must also have Informed Consent.

I understand what you are saying but, the lead is being generated with the intent for someone to sell something. If it is for tele sales then the rule is as I stated but, if it is for F2F then the only real obstacle is the written consent. Look I get that all the companies do it and don't care what the law is but, I believe it is why "real" companies like EFES changed there ways, because they follow the laws.

These aren't random or sequential numbers . . . They are numbers connected to a direct mail piece that was received but not responded to . . .

I imagine that some EFES agents use telemarketed leads, advatar leads, etc . . .
 
this is not a debate i really want to be involved in

you would have to sit in the room with my Lawyer and discuss it with him, half the stuff that comes out of his mouth doesn't make sense to me either but we pay him to keep fines away... those 10K fines can add up quickly when your dialer is on

And the rules that he has laid out for a typical telemarketer don't make sense to you because he is wrong. There is a difference between a telemarketer and a licensed agent. It appears he's not taking that into account.

Now, let's get a little more specific. Is he saying that any type of cold-calling is illegal or what? We all know to scrub against the do not call list, but is this what he's talking about? Was he talking about cold-calling in OH or all states? If he is just flat out saying that cold calling is illegal then he's not a layer that I would ever want defending me for something!

I just love company lawyers. Since we became an IMO I have found out that you can take one law and several companies will look at it and interpret it and the laws several different ways. Each company swears their lawyer is right even when it conflicts with the other company's lawyers. It can't be more than one way, yet these companies will stand by their lawyers in a heartbeat and trust them 100%.....even when you can prove them wrong.
