I have never signed a written contract with an IMO and I am sure FEX does not require one. However, an owner of the business can make the rules and also make exceptions to the rules as he pleases in the absence of a written contract. Therefore, I would be inclined to take the owner's word over that of a downline.All you have to do is ask Mr. Burke to provide the contract that spells that language out in the captivity provisions and if not then his hands are tied and there's nothing he can do.
