All the IRS has to do is first apply your payment, whether sent in or via payroll deduction, to the penalty first. Then when you come up short, it was on income tax and not the penalty. Problem solved. They aren't enforcing the penalty, just income tax as always.

Will they do that, who knows, but it is an easy way to be able to deny enforcing the penalty but still collect it.

"IRS revenue agents will not be involved. There will not be audits," IRS Deputy Commissioner Steven Miller told a subcommittee of the tax-writing Ways and Means Committee in the Republican-controlled House of Representatives.

We will see what the truth is sooner or later.. But consider this.. it makes absolutely no sense to pass a tax that you do not intend to levy and enforce.. I realize the US Government on a non partisan basis does many things that make no sense but failure to enforce tax code isn't one of them..
 
You're forgetting the famous quote of "no additional taxes on the middle class to pay for this law". Imagine the public outcry when the first penalty is levied. Obama may be called a liar in 2015.

For regular tax-paying folks, and definitely for higher-income folks, paying part of your tax bill makes no sense. It will come back to bite you later - if not by the IRS then on your new mortgage loan application or your next job application.
