Can Romney, if elected, issue waivers to all the states and kill this? Its that simple, if not - lights out. And I'm no pu$.


It's a mess. Not only does Obamacare need to get annual funding if it remains and all the shenanigans that go with that, if the republicans control the house but cannot repeal Obamacare after the elections they will hold the rest of the federal budget hostage to extract concessions and modifications on Obamacare.

And of course, Obama will concede or "open discussions on" several areas before the election to try to regain the high ground on the bill. He just wants to be re-elected and to be able to say that Obamacare survived and is a feather in his cap.

What a mess.

Sot he admin argues they can force you to buy health insurance via the commerce clause. The SCOTUS ignores the argument and thrusts forth its own argument that it is a tax? Why don't they just judge cases on the merits presented, not create new issues? The SCOTUS should be impeached.

This paragraph is basically the entire decision:

"The individual mandate cannot be upheld as an exercise of Congress's power under the Commerce Clause," Roberts wrote. "That Clause authorizes Congress to regulate interstate commerce, not to order individuals to engage in it. In this case, however, it is reasonable to construe what Congress has done as increasing taxes on those who have a certain amount of income, but choose to go without health insurance. Such legislation is within Congress's power to tax."

There will probably be only a handful of the biggest health insurers who stay in the business. Without a STRONG mandate, there's no way any but the top 4 or 5 can survive, and "adverse selection" will send them into a slow death spiral because people won't legally have to purchase health insurance until they need to use it!

Just posted about that. Some carrier will have to pay "day 1" after someone applies and goes into an iron lung.

Maybe providers will have applications laying around in the waiting room.

The whole premiss is to increase the pool and thus lower insurance rates. In theory, it is a win win for government, if you don't get insurance we collect a tax (we need tax revenue any way we can get right now)..and if they enroll in insurance it may increase the pool...they problem lies with the unhealthy or ones that can't get insurance that is underwritten...now what happens? It will force insurance companies to take everybody in hopes the pool will be full of healthy ones to make up for the unhealthy......we shall c

We have something similar here for auto insurance in NC. It is referred to as the "insurance facility" which is for non-standard people to go to when insurance companies do not want them. I could see health insurance companies doing something similar in that no one but the insurance company (and the agent) really knows where the client is since the insurance papers all read the same.

In NC there is a reduction in commissions from 15% normal to about 8-10% for facility-tiered clients. I can see healthcare insurance companies doing the same if there are commissions still to go out. I can also see the plans being hybrid with AFLAC-like products, too, which, I think since they aren't considered health-insurance, isn't affected anywhere. So now you have two-tiers of health insurance- one with GI benefits and rates but the other has some extra benefits such as perhaps lump-sum payments for certain life events or welness monies paid out for exams to prevent higher costs later. Obviously I don't know the law well enough for that but it seems like a good incentive to get people to buy early since you have ways to mitigate costs and the insurance company gets people when they are healthy.

I could see that working... or at least thrown around in the boardroom.

Right. The patient will get the immediate medical care he/she needs and avoid paying a tax-penalty to the Federal Government for that year.

Obama just paid for my summer vacation......yoohoo. Can't wait for that $1000 MLR refund in the mail.

More good news:
1. Entrepreneurs will be leaving companies in 2014, good for job growth.
2. Employers will be getting out of the health insurance business....good for job growth eventaully.
3. The IFP market will triple, we just need to hope that agents are involved in exchanges....(dependent on the state).
4. Private exchanges and defined contribution model will flourish.

But, HSA's are in danger, costs will double, and our books of business will be volatile, and our income is now at risk come 2014.

It's a tough analogy. In MD we have MAIF which is GI insurance for auto. But if you want to continue driving then you have to continue paying premiums. Drop it and the MVA is notified, then you get a letter calling for the return of your tags. Drive and you're risking jail time.

With this turkey, someone can lay low, pick up coverage, get that procedure and drop it.

The only good news is states are allowed to institute open enrollment periods. MA went with this about 2 years ago after seeing how many people were gaming the system.
