No, they are not.

Cigna is not refusing to insure children.

I didn't say that.

They are manipulating the marketplace and they are discouraging agents from submitting business to them that by law they must take.

I think what I might do is start running ads: Attention Moms and Dads. Does your kid have an incurable disease? See cigna.com - they will insure your entire family GUARANTEED.

I am not condoning their move, but I don't see anything illegal about stripping commissions on GI coverage.

Actually you are condoning their conduct by sitting on your laurels. The illegal part is in discouraging agents from submitting business to the company that by law they must accept.

And they are not stripping commissions on GI - they are stripping commissions on entire family fully insurable coverage where one person happens to be GI.

If you'll stop trying to be a penny-ante lawyer and check with the office of legal counsel at the Dep't of Ins. you might be surprised by what they have to say (assuming Cigna does business in your state)

By the way, although children are GI come Sept 23rd there's nothing in the legislation regarding the rates that can be imposed. Premium restrictions only apply to plans sold in the exchanges comes 2014.

As a worst case example, what do you think a family premium will be when the child has leukemia? Take a guess.

Except for the fact that HHS and states are already fighting carriers over rate increases. That won't change after 9/23.

Cigna will write kids that are part of a family plan but they won't do it through agents (unless the agent is really uninformed). At this point I don't see other carriers following this path. If they do it will be to their detriment.

As for now, Humana is still writing kid only plans.

Only until mid-August. From a recent e-mail:

• Child Only Applications- As of 8/14/2010 HumanaOne will no longer offer child only quotes. Pending quotes will be honored with effective dates prior to 9/23/2010.

Are they paying agents for the kid-only plans? I don't do anything individually with Humana ...

Humana is currently paying in kid only plans. As David pointed out, no more kid only after 8/14. I was told that about a week ago and told to keep it quiet until the "official" announcement.

so sman was right....if you have one GRT issue kid on a family policy the agent is screwed...so you have to write 2 app's...all healthy on one and grt issue on another....


Important Clarification
Commissions on Guaranteed Issue Policies

There have been a few questions about the notification sent yesterday regarding commissions on Guaranteed
Issue policies. The points below are intended to address these questions:

  • CIGNA defines a Guaranteed Issue policy as one that covers either a HIPAA case or one or more
    persons under age 19
    who do not meet current medical underwriting guidelines and therefore
    would have been declined coverage
    prior to the effective date of the Patient Protection and Affordable
    Care Act (PPACA).
  • In other words, only a policy that contains one or more persons under age 19 who do not meet the
    current medical underwriting guidelines
    is considered a Guaranteed Issue policy and therefore
    that policy is not eligible for commission.
3. Commissions will continue to be paid as usual on all other policies, per the applicable commission
schedule.


4. This change is effective October 1, 2010 for:

a. New policies with one or more persons who do not meet medical underwriting guidelines
b. Existing policies that are modified to include one or more persons who do not meet medical
underwriting guidelines

If any of you are still working today, how'd you like the Cigna email. The news is worse than we originally thought.

If you have a family that adds a GI child to the policy, commissions on that policy will cease.

I guess if you have young families on cigna plans that are still growing, you may not be able to count on the renewal commissions.

It just keeps getting better.
