Wellcare PDP Class Action Suit

Agents think they will be paid on MAPD for life for two reasons.
1. They believe all the Sales pitches that huckster FMO‘s pitch to them.
2. They haven’t grabbed a calculator and figured out the age of the people they’re writing up are usually older than their own age. Therefore, when the agent thinks he’s gonna retire on those sweet sweet renewals, his customer base is all dying off. Surprise, surprise, surprise!!!

Smart agents don’t believe such things. But that leaves a whole lot that do.
And the ones that believe the sales pitches have something else in common.

Most of them went to Facebook together.
 
There's a lot more inexperienced agents on this site than I had realized.

The naivety is hilarious, that anyone actually thinks any line of business is insulated completely from a hard market.

Flexibility is a must to survive in any business. Arrogance is followed by nothing but strife, only with humility comes wisdom.
 
100% of my MC biz is med supps. My clients and i sleep well.

98% of my under 65 book is now ACA.

In various years, using CMS Plan Finder and my medications, I have found Silverscript, Cigna, and Wellcare PDP plans to be the "best" plans for my situation.

In person, and on the forum, agents have made it quite clear to me that asking them to sell me those plans is an "unwelcome advance". I have just started using plan finder and not even asking any more.

That is my business decision.

Hm, I can't imagine why someone wouldn't want to write your PDP.

For the same reason (after your initial encouragement in 2016) you didn't want to sell me an HDF medigap. (I appreciate the encouragement you gave me in 2016 for buying an HDF. If I was an agent, I would have to be talking with you about your lead system and see if you thought after Duford and others saturate my market with cards, you thought there could still be available leads. I appreciate you saving me from the mistake of buying an MSA. I do not appreciate all the other crap you dish out.)

No commissions for the agent for products with the carriers I mentioned during the years they were the best fit for my situation.

(If I could ever understand how to make somarco's system of goodrx (or similar) vs the pdp work when Drs and Dentists call in prescriptions, I could have lowered the PDP premiums I had even more.)

Contrary to popular belief in the senior forum, I am a pretty good client - not in terms of $ volume of sales - but in terms of regular payment of premium and minimal interaction with the agent after the products are sold.

Pretty simple. Tell the pharmacist to run the Rx at GoodRx pricing; compare that dollar figure to your PDP price; pay the lower number.

I'm not Somarco but that's how my clients do it.

I have talked to two law firms specializing in Class Action, and both firms are willing to look at this more closely. The key here is of course for them to review the Wellcare contract in detail. If the contract review is positive, then the firms will need about 50 agents to join the suit to make it into a class action.

I did not save the PDF for the most recent Wellcare contract, so if anyone has that, please send me some sort of a PM so that we can get that to the law firms for review. Many thanks.

Kudos to you for investigating options, even though I have no clients with Wellcare, I sure hope they get their ass handed to them.

One does upfront work with expectations of future rewards ie (renewal commissions) and to have them change the contract mid stream is just not right.

No one reached out, so no one saves the contracts, or no one is interested in getting back their $50 or $60 or $70 k a year in Wellcare PDP commission ! In any case, I did find a copy of the contract, and sent it to two law firms for review. If any of the law firms want to go forward, I will reach out again with some more detail and the particulars of whatever lawsuit they want to bring. It will take 40 to 50 aggrieved parties to join, and once they do, I will do my best to make this thing an Opt-out class action (assuming the law firms go forward) In that case, you are in, unless you decide to be out and handle things on your own. My thinking is that a percentage of my lost commission is better than 100% of 0 .. others may disagree.

Tks brother. in my case I am only out around $5k a year, so not a career ending thing. I am doing this because if we do not challenge, the other companies will realize that a lot of the people who post here are paper tigers, and they will possibly start canceling MAPD commissions on flagship plans... at that point, the Medicare Advantage agency train goes off the cliff and I have to re-invent myself for the fifth time (not looking forward to it at my age)... funny that my handle is Mousemouth ... a lot of the people here should have the subhandle of "Bigmouth"
