The Fifth Circuit comprises Texas, Louisiana, and Mississippi.

The Third Circuit comprises Pennsylvania, New Jersey, and Delaware.

Unfortunately, the Circuit Court decisions are not binding on other Circuit Courts so I imagine this issue will eventually reach the US Supreme Court.
