OMG Cat. This is scary. HC.gov asks the same question, but uses 2015 in the "do you have insurance" question, I believe.
Can anyone else confirm this? I don't use HC.gov often enough to be exactly sure.

You should be answering No on that question for your applicants. This question is to make the distinction on whether the client will have access to ESI when the ACA plan starts.

Here's EXACTLY what HC.gov asks, Allen.
I made screenshots for you.....from an Active Renewal on HC.gov.
These questions (below) are all asked in the same section (one right after another). I've included ALL of the questions (in exact order) that they ask.
Is (applicant) enrolled in health coverage from any of the following?
- Texas's Medicaid Program
- Texas's CHIP Program
- Medicare
- TRICARE (Don't choose this if you have Direct Care or Line of Duty)
- VA health care program
- Peace Corps
X - Individual insurance (non-group coverage)
- None of these
Is (applicant) currently eligible for health coverage through a job (even if it's through COBRA or from another person's job, like a spouse)?
Select "Yes" if you could've enrolled in employer coverage for this year, even if the enrollment period for the employer coverage is over.

Will (applicant) be eligible for health coverage from a job during 2016 (even if it's through COBRA or from another person's job, like a spouse)?

(End of questions related to having insurance...and moves on to other stuff...related to SEP's...like births, adoptions, recent moves, just got out of jail?)
Allen, the goal of that question is to assess if the consumer is enrolled in other (non-ACA) subsidized coverage (medicaid, CHIP, etc.) for 2016, which would disqualify them for subsidy. If you mark yes, and then check the "Individual" policy (i.e. for a 2015 ACA plan) then the consumer is still eligible for subsidy. If your consumer has 2015 coverage that is ending in the next 60 days, then you should also mark no (hence the 2016 reference) - this is how HC.gov phrases the question.
Because ESI is relatively common, we explicitly broke it out into a separate question about whether or not the consumer's employer *offers* health insurance - even access is sufficient to disqualify for subsidy.
