Maybe We Should Start Suing?

To VolAgent and others, you guys think this is a big joke. I have no idea what the legal basis of my or a lawsuit will be...instead of peeing in my pool, why don't you help me think of one? Who knows, give me time and maybe I'll think of one that will work.

Thank God no one laughed at the people suing the Goberment on the constitutional issue of making people buy health insurance.

I've worked hard, very hard, to get myself in a financially stable position through Small Group. Of course I know that I have to sell other products...already doing that. But if you think it's just that easy then think again. Just like Full Throttle said. If everyone could easily do that, we'd all be sitting back in our underwear working 2 hours a day while earning $100,000 + a year.

Maybe the lawsuit idea is not doable. But hey, I've seen lawsuits with a lot less merit win. But at least I'm willing to fight for what I have built instead of just bending over and taking it from the Goberment.

It's amazing to me how many of us just "take it" and not even fight. We have no representation and just leave it to others' to make our future for us. It's because of US that we're losing this business, no one else. If we had a lobby group and/or powerful allies, things might be much different.

Where does this end? People say, "well, at least it's just Health Insurance which may or may not affect me" and the ever-poular "just sell other products" comment. But then comes taxation of Life Insurance, then comes the take-over of Long Term Care & Disability and so on.

Quite frankly, I can not take serious a man who can not spell government. Gobernment once or twice is cute, 10,000 times and it is annoying.

Also, you want to use the courts to make law, the same thing that most conservatives hate about liberals. You can't have it both ways, either the courts can make law for both sides or neither.

This is a legislative issue, pure and simple. If you want this overturned, and who in their right mind doesn't, then you need to get active politically. Help the politicians see the folly of their ways. Write your Members of Congress, write your State Legislature and make your voice heard. Encourage everyone you know and feels the same to write as well. Vote and actively support the politicians that represent your views.

But stop expecting the courts to be mommy and overrule daddy. That is what is wrong with our country. If we don't get our way, we'll just sue.

Of course the lawsuit is doable, you find the attorneys that will take this on without a hefty upfront retainer. It's easy to sit there and talk about the way things should be, it takes more than BS to do something about the way things are. t hall

Since you want to get on your high horse on spelling and being taken seriously, learn to use the correct word...it's "write" not "right".

The fact that agents are going to lose their livelihood, nothing to challenge there. Congress most certainly has the legal, not moral, right to legislate our profession out of business. Again, just ask everyone in prison on drug crimes about Congress and making your profession illegal. Or even better, talk to people in the payday loan business, and the impact legislation in certain states has had on them.

In the courts, you will lose when you win. About the only thing to overturn is the mandate to buy insurance. Unless the courts overturn the entire law because of that one provision, it will just accelerate the arrival of single payer and socialist medicine.

But go ahead, spend the money on the lawsuit. About the only attorney that will take the case without unfront payment is an activist attorney, and most of them are for this. Your only other chance is to get some activist group to bankroll the legal fees. Remember, even if you do win, there is no monetary judgement with which to pay the attorney.
