This Upcoming AEP

Normally, subsidies that are based on annual earnings are redetermined annually. However, I expect them to delay (err, I mean offer transitional relief) until April 15th, until every current subsidy recipient has completed the cycle and reconciled their subsidy with their tax return.

I hope you're right Ann! After all, in this country you're innocent until proven guilty. You can't prove guilt without adequate evidence. Full 2014 income will not be known until after 12/31/2014, unless the subsidy recipient stopped earning income prior to the end of the year.

Could the government have made it a tax credit based on last year's income? Would that have worked out better for everyone concerned?

This is exactly why I have been saying they won't need to do anything! Now get this, lets say they underestimated 2014 income by $3000. Will they now Not be allowed to estimate 2015 income? How can you do that? You can't....plain and simple....stuff happens and income changes. It'll all come out in the wash.... at Tax Time.

And let us not forget...the people who are receiving a subsidy probably aren't writing a check to Uncle Sam. They get a refund. So their refund goes down. Big deal.

May not be a big deal to you, but it is a big deal to most of them. They count on their refund.

There is a reason why the H&R Block offices are slammed from mid January to the first week of February. And most of those folks pay dearly for the RAL.

When I have explained the clawback to my subsidy clients, they all had the same attitude..."so what?"
 
Isn't having a United Healthcare executive in charge of the next Open Enrollment akin to "Insider Trading" on Wall Street? He'll be the first to see all filed rates, data and trends, and can advise UHC (where they participate 2015) accordingly.
