Down Syndrome

There was a discussion a while back and somebody(was it JD?)said they wouldn't let them do it. Was it because they weren't a legal guardian?

I have a friend who has a son that's 26 and has Down's Syndrome. I guess he can do all the ADLs when I think about it, but no way could he do a PHI...he can't even say a sentence.

One problem with getting life insurance for someone with Down's at that age is that they're not expected to live that long, that's something that the UW I spoke to mentioned.

Settlers says the mother can't do the phone interview unless she has "papers". The birth certificate is not papers.

Any suggestions for a carrier that will write a mid 30's guy with Down Syndrome? Mother has to answer and sign for home since he has no communication skills.

I wrote one last summer with SNL. T Overton sent me the app. I'm not sure what the product is called but it's a 3 year graded.

sister told me a rep wrote her bro LEVEL recently without anyone else present-----don't know if downs or a just retarded to some degree. As I looked at the app all NO answers and didn't see anything that closely described his mentality but she said he likely would not have understood enough to accurately answer the questions. Even if in fact all questions were accurately NO during contestability could that not be any issue even if physical health was good???? Sister did not have formal POA but agent shouldn't be writing him without an even a non-legal rep to answer there, right?. We don't write those with advanced dementia but that appears on app and some retardation doesn't?

Does the application argue about mental incompetency? If not, then he may have answered everything correctly.

Someone would have to argue that he wasn't mentally competent at the time of the application. I doubt the company would as then they entered into a contract with someone who was mentally incompetent. It might be more trouble than it is worth for them.

I would probably call the company and ask about it, without mentioning this particular policy or insured in any fashion.
