Tough Position

They aren't guarantee issue coming off group in all states if they just decide to leave their plan. If they lose it involuntarily then they would be GI to Med Sup.

I haven't dealt with this because my state is GI voluntary or involuntary loss of EGHP

But what if the insured who is the retired employee cancels it and the spouse has no control over his decision to cancel the coverage - is that not considered involuntary loss for for the her ?

I'm not sure how they would handle that situation, that would be one I would call the insurance company about before hand and see if that counts as involuntary loss of coverage.

I have cleared that one getting someone on the under 65 state insurance pool. One of the qualifications was that they could not have other options such as Cobra, the wife was the "plan member" he was the spouse, I told the wife to not take Cobra, he had no other insurance options, he got MHIP
