Just curious. What is the difference in what he is proposing and all the Geico, Progressive, State Farm, Allstate "comparison" commercials you see on TV?


They have teams of lawyers and lots of money.

Believe me. Every insurance agent has dreamed of doing this. But no one does. Do you think there is a reason for that?

Maybe we have all been bluffed? I am not going to try it but if a person did, I would think the worst that would happen in the beginning is the insurance company would send you a cease and desist letter. Then if you didn't comply they might start legal action. But then, if I am wrong you could be in a big pile. :yes:

If you even use the name of a company you are actually selling you will get that if you don't get prior approval.
 
We are all forgetting our State Licensing Tests....

In most States if you mention another company in any communication to a prospect, Phone, Mail, Internet, etc without a direct appointment you are committing an act of "Misrepresentation". This is actionable in Most States and will cost you a slap on the wrist.

The Broker States, CA as an example, may have a loose definition but still have your License disclosure requirements.

Best bet......... Just use what if's..... no names.

True.. but that is also a matter of contract between you and the company. Every contract I have signed states I have to have prior approval for advertising using the company name.

Here is a good Blog article on comparative advertising.. Notice the statement "being right does not keep you from being sued".. While what is being proposed may be perfectly legal and correct, it is that thought that prevents most of us from trying it.

I think it woulds be easier,maybe almost as effective to post low ball rates or a something like Assurity used to supply, table showing ages and rates, "If you are paying more than this call me before it is too late!"
