The nine workers at a Boise facility who brought the suit against Maximus Inc. say the case could potentially apply to thousands of employees, and they're asking a judge to award damages exceeding $5 million.
Maximus, which operates under a government contract, has not yet filed a response.
Some former Maximus employees have written to LawyersandSettlements to complain about the company's practices. These include not being paid for overtime work, not being paid promised bonuses, unequal pay for equal jobs and wrongful termination. The law requires that people who are not considered exempt be paid for working overtime hours. That includes working over 40 hours in one week, which many employees at Maximus allegedly do.
Two types of employees at an Obamacare call center in Idaho have filed a putative wage and hour class action lawsuit against contractor Maximus Inc., alleging that the company miscategorized them as exempt employees per the Fair Labor Standards Act (FLSA) among other violations of the federal statute.
Generally speaking, there could be about 150 Class Members among the call center staff, and across the entire class there are allegations that all were entitled to overtime, considering that most employees worked 50 to 60 hours per week beginning last summer. They also cited violations of the FLSA regarding clocking out before they actually stopped working and not being able to take advantage of mandatory lunch and other breaks.
